On March 25, 2026, a crash happened on Highway 56 in Chauvin.

Louisiana State Police say a car was speeding and did not slow down. It hit the back of a truck in front of it. The truck went off the road and flipped over.

A 58-year-old man died at the scene. He was not wearing a seatbelt.

The driver who caused the crash was also not wearing a seatbelt and was badly hurt.

Police later said the driver was over the legal alcohol limit. He was arrested and charged with:

  • Vehicular homicide
  • DWI (first offense)
  • Reckless driving
  • Driving under suspension

What Went Wrong in the Terrebonne Parish Crash

This crash did not happen by accident alone. It happened because of several bad choices.

  • The driver was speeding
  • The driver did not slowdown in time
  • The driver was drinking alcohol
  • Both drivers were not wearing seatbelts

We often see this in car wreck cases in Baton Rouge and Ascension Parish. Speed and alcohol make it harder to react. When a driver cannot react in time, crashes become more serious.

Why Drunk Driving Makes a Case Stronger

Driving under the influence is illegal in Louisiana.

Under La. R.S. 14:98 (DWI law):

A driver cannot operate a vehicle with a blood alcohol concentration of 0.08% or higher.

When impaired driving causes a death, it can lead to vehicular homicide under La. R.S. 14:32.1:

From a civil case standpoint, this has a major impact.

It often means:

  • Liability is easier to prove
  • The conduct is considered reckless, not just careless
  • Insurance companies evaluate the claim more seriously

In many DWI crash cases in South Louisiana, toxicology evidence becomes central. It helps establish causation and strengthens wrongful death claims. Learn more about Chris Corzo as a wrongful death lawyer here.

At firms like Chris Corzo Injury Attorneys, early steps often include securing toxicology results, crash reports, and witness statements before critical evidence is lost.

Who Is at Fault in a Rear-End Crash?

In Louisiana, the driver in the back is usually at fault.

Drivers must:

  • Keep a safe distance
  • Stay in control of their car

Louisiana courts have said these many times.

  • The driver was speeding
  • The driver did not slow down
  • The driver was drunk

This makes fault even clearer.

In many Baton Rouge and Ascension Parish cases, once fault is clear, the focus moves to how much the case is worth.

Does Not Wearing a Seatbelt Affect the Case?

Both drivers were not wearing seatbelts. This does not cause the crash. But it can affect how much money a family may get.

Louisiana uses something called comparative fault. (La. C.C. Art. 2323)

This means:

  • Fault can be shared
  • Money can be reduced by a percentage

If a seatbelt could have reduced the injury, the defense may try to lower the amount paid. But they must prove it with real evidence.

Important: Law Change for Fault in Louisiana

Louisiana changed how fault works starting January 1, 2026.

For crashes before January 1, 2026:

The state used a pure comparative fault system.

For crashes on or after January 1, 2026:

Louisiana now uses a modified comparative fault system.

  • You can recover money only if you are 50% or less at fault
  • If you are more than 50% at fault, you get nothing

Why This Matters Here

This crash happened on March 25, 2026. That means the new law applies.

So, if fault is shared, the percentage matters more than before.
