How Long Do You Have to Report a Car Accident in Baton Rouge?

When Am I Required to Report A Baton Rouge Car Accident?

Louisiana Revised Statute 32:398(A) provides:

“The driver of a vehicle involved in a crash resulting in injury to or death of any person or property in excess of five hundred dollars shall:

  1. Immediately give notice of the crash to the local police department if the crash occurs within an incorporated city or town or, if the crash occurs outside of an incorporated city or town, to the nearest sheriff’s office or state police station….”

This means that if you are involved in a Baton Rouge car accident that results in death or injury of any type or property damage in excess of $500, you must report the accident immediately. Almost all car accidents fall within this description, so you effectively must report all car accidents.

Immediately likely means that you must call the police moments after the accident while still at the scene. Of course, you should always remain at the scene until released by the investigating officer.
