What Is Wrongful Death?

A wrongful death is a death caused by the negligence or wrongful conduct of another party. Louisiana Civil Code Article 2315.2 provides a cause of action for specific family members to recover damages when a person dies due to the fault of another.

Common Causes of Wrongful Death in St. Gabriel

Motor vehicle accidents, such as car, truck, or motorcycle accidents, are the most common cause of wrongful death in Louisiana. Other common causes include medical malpractice, workplace accidents, premises liability injuries, and defective product injuries.

Sadly, intentional acts of violence are also a common cause of St. Gabriel wrongful death claims. When the act causing death is intentional, criminal charges are likely also to be filed. A civil wrongful death action is entirely separate and distinct from any criminal charges the state may prosecute against the defendant.

Who Can File a St. Gabriel Wrongful Death Claim?

Louisiana Civil Code Article 2315.2 (A) outlines the persons who may file a wrongful death as follows:

 (1) The surviving spouse and child or children of the deceased, or either the spouse or the child or children.

            (2) The surviving father and mother of the deceased, or either of them if he left no spouse or child surviving.

            (3) The surviving brothers and sisters of the deceased, or any of them, if he left no spouse, child, or parent surviving.

            (4) The surviving grandfathers and grandmothers of the deceased, or any of them, if he left no spouse, child, parent, or sibling surviving.

How Long Do I Have to File a Wrongful Death Claim in St. Gabriel?

As provided in Louisiana Civil Code Article 2315.2(B), a wrongful death action must be filed within one year from the death of the deceased or two years from the day that the injury or damage that caused their death happened, whichever is longer.
