Louisiana’s Comparative Fault Law

Effective January 1, 2026, Louisiana will move from following a pure comparative fault rule to a comparative fault model with a 51% bar.

If they are 50% or less at fault, they can still recover compensation, but it will be reduced by the percentage of fault assigned to them.

For example, if you are found to be 40% at fault and your damages total $100,000, you could still recover $60,000 after deducting your percentage of fault.
